Legionella is a biological agent under the Safety, Health and Welfare at Work (Biological Agents) Regulations 2013 and 2020, which require the employer to assess the risk of exposure and to prevent or control it. Sections 8, 12 and 19 of the 2005 Act add the general duty to protect employees and others, including tenants, guests and visitors, and the duty to assess. Legionellosis is a notifiable disease in Ireland, and an outbreak traced to a building brings the HSE and the HSA to the door. The person in control of the premises, the owner, landlord, employer or managing agent, is the duty holder.
A competent assessor surveys the water systems: the source and incoming supply, cold water storage tanks, hot water calorifiers and cylinders, the distribution pipework including dead legs and little used outlets, showers, taps, thermostatic mixing valves, cooling towers and evaporative condensers, spa pools, humidifiers, water features and any other aerosol source. For each, the assessment records the temperatures, the condition, the materials, the stagnation risk, who could be exposed and how vulnerable they are, and rates the risk.
The assessment produces a written scheme: a schematic of the systems, the control measures for each risk, the monitoring tasks with frequencies, the people responsible, the records to keep and the actions when a check fails. Typical tasks: monthly temperature checks at sentinel outlets, weekly flushing of little used outlets, quarterly shower head cleaning and descaling, six monthly tank inspections, annual calorifier inspection and periodic sampling where the assessment calls for it.
The assessment is reviewed at least every two years and whenever the system changes, the use of the building changes, the monitoring shows control is being lost, a case of legionellosis is linked to the premises, or new information about the risk emerges. Records are kept for at least five years.
