The employer must take appropriate organisational measures, or use the appropriate means, in particular mechanical equipment, to avoid the need for manual handling. Where it cannot be avoided, the employer must assess the task using the risk factors in Schedule 3 and take measures to reduce the risk, particularly of back injury. Workers must be given general indications and, where possible, precise information on the weight of each load and the heaviest side of an off centre load.
Schedule 3 lists the factors an assessment must consider: the characteristics of the load (too heavy, too large, unwieldy, unstable, positioned so it must be held away from the trunk), the physical effort required (too strenuous, twisting, sudden movement, unstable posture), the characteristics of the working environment (space, floors, temperature, lighting, levels), the requirements of the activity (frequency, distance, rest periods, imposed pace) and individual risk factors (physical suitability, clothing, knowledge and training).
Employers must ensure that employees involved in manual handling receive general indications and, where possible, precise information on how to handle loads correctly and the risks they might face if the loads are handled incorrectly. The HSA expects this to be delivered by a competent instructor, to include the principles of safe handling, and to be refreshed periodically; a three year cycle is the widely accepted standard.
HSA inspectors ask for the manual handling risk assessments, the safety statement and the training records. Failures can lead to improvement notices, prohibition notices and prosecution under the 2005 Act. After an injury claim, the same records decide whether the employer met the legal standard.
