Section 14A(2) makes the employer answerable for harassment in the course of employment as if the employer had done it. Section 14A(2) also provides the defence: it is for the employer to prove it took such steps as are reasonably practicable to prevent the harassment, and where it has occurred, to reverse its effects and prevent recurrence. Section 15 adds the general vicarious liability for acts of employees. The Workplace Relations Commission and the Labour Court read the IHREC Code of Practice as the measure of reasonably practicable.
The Code of Practice on Sexual Harassment and Harassment at Work, issued by the Irish Human Rights and Equality Commission under the Acts and in force since 2022, expects every employer to have a written policy that defines harassment and sexual harassment with examples, states that they will not be tolerated, applies to third parties as well as staff, and sets out informal and formal complaint procedures with named contacts, time limits, confidentiality, protection from victimisation and the sanctions that may follow. The policy is communicated to all staff, included in induction and reviewed regularly, and managers are trained to recognise, prevent and handle harassment.
The Code expects training for all employees on the policy and their responsibilities, and specific training for managers and the people who receive complaints. A policy nobody has read and training nobody has had do not amount to reasonably practicable steps. Records of training and of policy communication are what the employer produces at the WRC.
A complaint to the Workplace Relations Commission must be made within six months of the last act, extendable to twelve for reasonable cause. The WRC can award compensation of up to two years' remuneration for discrimination including harassment, plus orders to take specified courses of action, and the decision is published. Add legal costs, management time, staff turnover and reputational damage. A policy and an hour of training per employee cost a fraction of one case.
